Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website digit29.com and the products and services offered by Digit29 Technologies Private Limited ("Digit29", "we", "us"), including the Drifty mobile application (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms.

1. About Digit29

Digit29 Technologies Private Limited is a company incorporated in India under the Companies Act, 2013, with its registered office at the address provided at the end of these Terms and in the footer of digit29.com.

2. Eligibility

You must be at least 13 years old to use our Services. By using the Services, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization.

3. Your account

Some of our Services may be used without an account (for example, Drifty pairs users via a session code rather than a traditional account). Where an account is required, you are responsible for the activity that occurs under your account and for keeping your credentials secure. Notify us promptly at hello@digit29.com if you suspect unauthorized use.

4. Acceptable use

You agree not to use the Services to:

• Violate any applicable law or the rights of others;
• Harass, threaten, or harm any person;
• Distribute unlawful, infringing, or otherwise objectionable content;
• Attempt to gain unauthorized access to the Services or to any other user's account or device;
• Interfere with or disrupt the Services or the servers and networks that host them;
• Reverse engineer or attempt to extract the source code of the Services, except where permitted by applicable law.

5. Content and conduct

You are solely responsible for any content you transmit through the Services, including messages, media, and other communications. Because Drifty conversations are end-to-end encrypted, Digit29 does not monitor or have access to the contents of messages between paired users. You retain all rights in your content. You grant Digit29 only the limited technical rights necessary to deliver the Services to you (for example, to relay encrypted messages).

6. Intellectual property

The Services, including their software, design, trademarks, and other content provided by Digit29, are owned by Digit29 or its licensors and are protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, sell, or otherwise exploit the Services without our written consent.

7. Privacy

Your use of the Services is also governed by our Privacy Policy, which describes how we collect and use information.

8. Third-party services

The Services may rely on third-party platforms (for example, the Apple App Store) and on third-party service providers (for example, cloud hosting). Your use of those services is subject to their own terms.

9. Disclaimers

The Services are provided "as is" and "as available". To the maximum extent permitted by applicable law, Digit29 disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or completely secure.

10. Limitation of liability

To the maximum extent permitted by applicable law, in no event shall Digit29, its affiliates, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Services. Our total aggregate liability for any claim arising out of or relating to these Terms or the Services shall not exceed one thousand Indian Rupees (INR 1,000) or the amount you paid us in the twelve months preceding the claim, whichever is greater.

11. Termination

You may stop using the Services at any time. We may suspend or terminate your access to the Services if you violate these Terms or if we are required to do so by law. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, limitations of liability, and dispute resolution) will survive.

12. Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date above. Continued use of the Services after the update means you accept the revised Terms.

13. Governing law and jurisdiction

These Terms are governed by the laws of India. The courts located in Bengaluru, Karnataka, India shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms.
